Criminal Defence & Litigation

Services Offered

End-to-End Criminal Defence

Defence Representation

As a criminal litigation law firm in India, we review the prosecution’s evidence, conduct independent investigations and formulate defence strategies aimed at securing favourable outcomes for our clients.

Trial Preparation & Advocacy

We prepare for trial through thorough legal research, evidence gathering and identifying key witnesses, then skilfully present evidence, examine witnesses and argue legal points in the courtroom.

Pre-Trial Negotiations

We engage in pre-trial negotiations with prosecutors to resolve cases outside of trial, seeking alternative resolutions that mitigate potential penalties for our clients.

Regulatory Enforcement & Litigation

We represent corporate clients before regulatory agencies, ensuring compliance and defending against enforcement actions — managing all aspects of litigation, from pre-trial negotiations to trial and appeals.

Bail & Anticipatory Bail

We secure anticipatory bail under Section 482 BNSS before the Sessions Court and Delhi High Court, regular bail after arrest under Sections 480 and 483, and default bail under Section 187(3) where the chargesheet is delayed. See bail in ED cases under PMLA.

FIR Quashing

We file petitions before the Delhi High Court under Section 528 BNSS (earlier Section 482 CrPC) to quash FIRs and proceedings that disclose no offence, are an abuse of process, or arise from disputes the parties have settled.

Cheque Bounce Resolution

We assist corporate clients facing cheque-bounce issues — sending legal notices, negotiating settlements and representing corporations in proceedings under the Negotiable Instruments Act.

Money Recovery Services

We excel in debt recovery — from drafting demand letters to filing recovery suits, executing arbitration clauses and pursuing enforcement of judgments — ensuring maximum recovery of dues in a timely manner.

Juvenile Defence

We represent minors facing juvenile delinquency proceedings, advocating for their rights and protecting their constitutional and procedural safeguards.

Defence Against Corporate Criminal Charges

Corporations can face charges such as fraud, embezzlement, corruption and regulatory non-compliance. We provide a robust defence, handling all aspects of the criminal process.

Filing Criminal Appeals

We offer specialised assistance filing criminal appeals across India — preparing and filing appeals, reviewing trial records, identifying legal errors and crafting persuasive appellate briefs.

Preventive Legal Counselling

We offer preventive counselling to help corporations comply with financial regulations, anti-corruption laws and corporate governance standards — reducing the risk of criminal charges and financial disputes.

Work Highlights

Results Under Pressure

Criminal Litigation Advocacy

In a recent landmark case, we represented a large manufacturing company whose corporate debtor had defaulted on a significant payment evidenced by multiple bounced cheques. We sent a stringent legal notice that prompted immediate settlement discussions and recovered the full amount plus damages through a structured payment agreement, avoiding prolonged litigation.

Regulatory Defence for a Financial Institution

We defended a financial institution accused of fraudulent practices in loan issuance. Our in-depth investigation revealed procedural lapses without criminal intent; by presenting comprehensive evidence and negotiating skilfully with regulatory bodies, we had most charges dropped with minimal fines instead of criminal penalties — preserving the institution’s licence and reputation.

Defensive Strategies for Corporations

For a multinational facing repeated challenges over non-compliance with new financial regulations, we devised and implemented a tailored compliance programme — training sessions, regular audits and updated internal policies — significantly reducing legal risk and strengthening the client’s corporate governance and compliance culture.

How does a criminal case move in Delhi?
An FIR is registered under Section 173 BNSS (a zero FIR can be lodged at any police station); police investigate and may arrest or issue a notice; an arrested person is produced before a Magistrate within 24 hours; bail is sought; a chargesheet is filed; charges are framed; evidence is led and the court delivers judgment, with appeals to the Sessions Court, Delhi High Court and Supreme Court. The BNSS replaced the CrPC from 1 July 2024 — see how the BNSS changes criminal procedure.
How do I get anticipatory bail in Delhi?
An application for anticipatory bail is filed under Section 482 of the BNSS (earlier Section 438 CrPC) before the Sessions Court or the Delhi High Court. The court considers the nature of the accusation, the applicant’s antecedents and the risk of flight or tampering with evidence.
What is the difference between bailable and non-bailable offences?
In a bailable offence, bail is a matter of right and is granted by the police or the Magistrate. In a non-bailable offence, bail is at the discretion of the court and must be applied for under Sections 480 or 483 of the BNSS.
Can an FIR be quashed?
Yes. The High Court can quash an FIR or criminal proceedings under its inherent powers (Section 528 BNSS, earlier Section 482 CrPC) where the allegations disclose no offence, the case is an abuse of process, or the parties have settled a largely private dispute.
What should I do if police refuse to register my FIR?
You can send a written complaint to the Deputy Commissioner of Police and, if no action follows, apply to the Magistrate under Section 175(3) of the BNSS seeking a direction to register the FIR and investigate.
What is default bail?
If the investigation is not completed and the chargesheet is not filed within 60 or 90 days (depending on the offence), the accused becomes entitled to default bail under Section 187(3) of the BNSS.
Which courts in Delhi do you appear in?
District courts at Patiala House, Tis Hazari, Saket, Karkardooma, Rohini, Dwarka and Rouse Avenue (including special PMLA and CBI courts), the Delhi High Court and the Supreme Court of India.
What documents should I bring to the first meeting?
A copy of the FIR, complaint or police notice; any summons, warrant or court order; the arrest memo and remand papers if arrested; related messages, emails, contracts or payment records; and a short written timeline of events.
